Statement by the BRS re Orams case

 

The BRS is pleased by the order of the Court of Appeal to grant permission for it to intervene through written submissions in the appeal against the decision of Justice Jack in the case of Apostolides v Orams. With this permission, the BRS will be able to assist the Court on complex international law issues.

 

The essence of the BRS` intervention is that customary international law rules on State jurisdiction do not allow the District Court of Nicosia to exercise jurisdiction concerning immovable property situated in northern Cyprus.

 It is a principle of English public policy that courts should give effect to these rules of international law. Recognition and enforcement of the judgments given by the District Court of Nicosia in contravention to customary international law rules on State jurisdiction would constitute a breach of English public policy.

 

This case is of vital importance for the BRS which represents the interests of over 1200 members and more than 10,000 expatriates living in North Cyprus.
